Since 2021, GPS Air® has been the target of lawsuits built on the same false narrative that spread during the pandemic: that the company’s air purifiers were marketed improperly and did not perform as claimed. One by one, those cases have failed. The latest to fall is a consumer class action in the U.S. District Court for the District of Delaware.
On July 7, 2026, the court decertified the class, ending the case as a class action. The court found that the plaintiff could not reliably identify the consumers the suit claimed to represent. As Judge Stephanos Bibas wrote, “Class certification rests on facts, not forecasts. The forecast in this case did not pan out.” Earlier in the same case, the court had already refused to let the central accusations move forward, including the claims that GPS Air’s products were unsafe or ineffective against COVID-19.
This is not the first time these claims have come apart under scrutiny. A related class action before the same court was dismissed in 2025. A separate lawsuit making the same allegations was investigated by the U.S. Department of Justice, which reviewed the company’s product testing, marketing, and laboratory practices, declined to pursue the case, and saw the plaintiffs dismiss it. Every time these allegations have been tested against the evidence, they have failed.
