In early 2021, some competitors of GPS Air targeted the company and made false, defamatory statements about GPS Air and its technology. These competitors falsely claimed the company’s proprietary technology was not effective or safe. GPS Air sued the competitors and a scientific journal for making the defamatory statements. As part of a settlement, the competitor defendants retracted the false statements about GPS Air. The suit against the scientific journal is ongoing and moving into the discovery phase.
Unfortunately, as part of these targeted, false attacks, another group of competitors filed under seal a qui tam lawsuit in February 2021 making the same, false claims about GPS and its technology. Under the qui tam statutory procedure, the U.S. Department of Justice (“DOJ”) was required to investigate the allegations. The case was recently unsealed and dismissed which is why we are providing this update now.
After a thorough review and investigation of the allegations, the DOJ concluded there were no false claims made by the company, and the DOJ declined to intervene in the case. The DOJ further requested that the qui tam plaintiffs dismiss the case which they agreed to do and formally filed the dismissal on October 9, 2025, thereby concluding the case. During the investigation, the DOJ exhaustively reviewed GPS product testing, marketing claims, and testing laboratory actions. The result of the investigation was unequivocal that GPS Air had made no false claims about its technology.
